Terms of service

The agreement between you and Maikhana LLC for the use of Firesell.

Effective 17 September 2026.

1. Agreement

These terms are a contract between Maikhana LLC (“we”, “us”) and the business that creates an account (“you”). By creating an account or using Firesell, you accept them. If you accept on behalf of a company, you confirm that you are authorized to bind it.

2. The service

Firesell is a web application that connects to your Amazon selling account and helps you manage listings, inventory, pricing, orders, fulfillment records and financial reporting. It acts on your instructions and within the permissions you grant.

3. Eligibility and accounts

  • You need an Amazon professional selling account that you control.
  • You are responsible for your account, the people you invite, the roles you give them, and everything done under your organization.
  • Keep your sign-in credentials confidential and tell us promptly of any misuse.

4. Your Amazon authorization

  • You authorize Firesell from your own Amazon account. We never ask for your Amazon password.
  • You appoint us to access the Selling Partner API on your behalf, limited to the roles you granted and to the operations the product performs.
  • You may revoke at any time, inside Firesell or in Seller Central. Revoking ends our access immediately and will stop parts of the service from working.
  • You remain responsible for complying with your agreements with Amazon, including listing and pricing policy. We comply with the Amazon Services API Acceptable Use Policy, Data Protection Policy and Solution Provider Agreement.

5. Your data

Your data stays yours. You grant us only the license needed to host, process and display it so that the service works, and to keep backups. We handle it as described in the privacy policy, which forms part of these terms.

6. Acceptable use

You agree not to:

  • Use Firesell to breach any Amazon policy or any law.
  • Access another business’s data, or connect an Amazon account you are not authorized to manage.
  • Resell, redistribute or publish data obtained through the service.
  • Probe, scan, reverse engineer or overload the service, except for security research reported to us in good faith.
  • Use the service to send unsolicited messages to Amazon buyers.

7. Early access

Firesell is offered in limited early access. Features may change, and we will tell the account administrator before we remove or materially change one you rely on.

8. Fees

Subscription fees, billing period and any trial are set out in the order form or plan you accept before you are charged. Fees exclude taxes. Unless the order form says otherwise, fees are not refundable for a period already started, and we will give at least 30 days notice before a price change takes effect.

9. Availability and disclaimers

We work to keep Firesell available, but we do not promise uninterrupted service. Parts of the service depend on Amazon systems that we do not control, and Amazon may change, throttle or withdraw its APIs. Except as these terms state, the service is provided “as is”, without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any sales, ranking, ad performance or financial outcome.

10. Limitation of liability

Neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim arising out of these terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.

11. Indemnity

You will defend and indemnify us against claims arising from your data, your use of the service in breach of these terms, or your breach of an agreement with Amazon.

12. Suspension and termination

  • You may close your account at any time.
  • We may suspend an account that is causing harm, breaching these terms, or putting our Amazon developer status at risk. Where practical we will warn you first.
  • On termination, access ends. You may request an export during the 30 days that follow, after which we delete your data as described in the privacy policy.

13. Changes to these terms

We may update these terms. Material changes take effect 30 days after we post them and email the account administrator. Continuing to use the service after that means you accept them.

14. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of law rules, and the state and federal courts located there have exclusive jurisdiction.
